  • Hurricane damage and wind damage – All insurers are required under Florida law to cover wind damage that occurs during a storm declared a hurricane;
  • Arson;
  • Fire damage;
  • Sinkholes – Florida code section 627.706(2) requires that all authorized insurers cover damages caused by ground cover collapse;
  • Broken pipes;
  • Mold;
  • Flooding – Most policies do not cover flood damage, so it is important to understand what is covered on your specific policy;
  • Hailstorms.

When your insurance company won’t pay you the money that you are owed per your policy agreement, our attorneys are ready to fight for your rights!

Remember, each homeowners’ insurance policy is different – we help you to understand and decipher your specific policy, and negotiate for the payments you’re owed.

What You Need to Know When Your Homeowners’ Insurance Claim Is Denied

If your homeowners’ insurance claim is denied, or if you are offered less than you believe you are entitled to, you have the right to not accept a settlement offer. Further, you have the right to fight back against a denied or lowballed claim and negotiate for a higher amount. Claims are often denied due to allegations of homeowner negligence and claims that the damage was caused by an excluded accident type, or because the insurance company states that premiums were unpaid or paid late. The truth is, however, that insurance companies will almost always find a way to pay you less than you are owed to save the company money. Our attorneys do not stand for this, and have the skill set, experience, and knowledge of the law that you need when your claim is denied.

West Palm Beach Homeowners’ Insurance FAQs

Homeowners’ insurance and its many provisions can be confusing to understand. However, homeowners’ insurance is an important insurance type, and can help you to pay for damages if your house is damaged or someone is injured on your property. Here are some frequently asked questions that our lawyers at the Celeste Law Firm often hear from our clients:

Am I Required to Carry Homeowners’ Insurance?

Both the state, and individual cities and counties, can and do set laws regarding homeowners’ requirements to carry insurance. Under Florida state law, there is no requirement to carry insurance for the loss of structure. However, many cities and counties in Florida do require homeowners to carry liability insurance, which can help to pay for injured incurred by others on a property, as well as property damage to another home (for example, a tree on one property falls onto a home on a separate property).
Keep in mind that regardless of state or city or county law, mortgage lenders almost always make a loan contingent on acquiring homeowners’ insurance.

What is My Homeowners’ Insurance Provider Required to Cover?

If you do carry homeowners’ insurance – which is very strongly recommended – your policy may be very different from your neighbors. Typically, you will pay more for higher coverage amounts and different coverage types. Regardless of the type of homeowners’ insurance that you carry though, Florida law requires that insurers provide coverage for damage caused by:

  • Sinkholes; and
  • Wind damage from hurricanes;

Other coverage types, such as coverage for mold and fungi, or flood coverage, is not required.

What Happens if My Insurance Company Denies Coverage, or Offers Me Less than I Think My Claim Is Worth?

If your insurance company denies your homeowners’ insurance claim or offers you less than you think you deserve, you do not have to accept its offer. In fact, you have the right to reject a settlement offer and negotiate for a higher amount. If your claim is full out denied, you should take action immediately to dispute the decision.

Do I Need a West Palm Beach Homeowners’ Insurance Attorney?

It is easy to think that your homeowners’ insurance company is on your side and has your best interests in mind. Unfortunately, this is rarely the case; usually, the insurance company wants to save money by paying you as little as possible.
