Workers Compensation

construction workersWorkers’ compensation laws main purpose is to ensure that employees who are injured on the job are able to continue receiving fixed monetary income, without having to file litigation claims against their employer. The employer is also protected, because laws limit the amount employees can recover from their employers, and prevents employees from suing co-workers in most cases.

Workers’ compensation is a system of laws that outline specific benefits employees are entitled to if injured on the job. Every state has its own workers’ compensation laws, which are in the form of statutes. In almost every state every business must contain some form of workers’ compensation insurance. When you file a workers’ compensation claim you are simply requesting benefits, not filing a lawsuit against your employer.

In some cases, if you are injured on the job you can seek third party compensation (manufacturers of machinery.) These claims usually take place in civil court, not in the workers’ compensation system. If you do file a third party suit your employer may be able to recover their workers’ compensation payments.

In some states certain types of occupations are exempt, such as agricultural employees, domestic employees, and independent contractors. In other states employers do not have to have workers’ compensation coverage unless they employee a minimum number of workers. Contact an experienced workers’ compensation lawyer to find out more.

If you are not covered by workers’ compensation, you may be able to file a civil claim against your employer.

If you have sustained any of the injuries below on the job, you may be entitled to compensation.

  • Preexisting conditions that the workplace accelerates or aggravates. Examples may include a back injury, even though you don't notice the pain from the injury until later.
  • Injuries caused during breaks, lunch hours, and work-sponsored activities (such as a company picnic), and at-work injuries caused by company facilities, such as a chair in the company lunchroom.
  • Diseases such as lung cancer, if contracted by exposure to toxins at work as a result of normal working conditions.
  • Injuries resulting from mental and physical strain brought on by increased work duties or work-related stress. In some states, this includes employees who develop a disabling mental condition because of the demands of the job and a supervisor's constant harassment.
